I recently had the privilege of representing a client whose long-term disability (LTD) benefits were wrongfully terminated after ten years of receiving monthly benefits. Our client, a 62-year-old from Rhode Island, had previously thrived in a highly demanding cybersecurity role as a data security specialist. However, because of severe and progressively worsening health conditions, they could not continue in their profession or any related field.
Reliance Standard Cut-Off Long-Term Disability Benefits
The insurance company, Reliance Standard Life Insurance (RSLI), ended benefits because it asserted that the claimant could perform less demanding jobs, such as a Data Entry Clerk or Customer Service Representative, despite the claimant’s chronic and debilitating conditions
This decision was based on a cursory and flawed evaluation of our client’s physical capabilities, completely disregarding the degenerative nature of their disabilities, which included chronic pain, right median neuropathy, right wrist pisiform excision, ulnar nerve lesion, right ulnar neuropathy, right cubital tunnel syndrome, left-hand stage III basal joint arthritis, bilateral De Quervain’s Syndrome, previous unsuccessful cubical tunnel syndrome surgeries, and degenerative changes in the right wrist bone.
Our Appeal Successfully Overturned the Denial
In our appeal, we meticulously challenged RSLI’s decision by highlighting the serious and permanent nature of our client’s health issues. We argued that these conditions were progressive and expected to deteriorate further, making any form of employment unsustainable. We also pointed out that RSLI had failed to accurately analyze the definition of sedentary employment and consider the erosion of the sedentary occupational base in their denial of our client’s claim.
Our efforts resulted in a successful overturning of the denial by RSLI, reinstating the much-needed benefits to our client, thus securing their financial support and access to necessary medical care.
