Long Term Disability Claims
National disability attorney Nick A. Ortiz is familiar with the tricks and tactics insurance companies use to wrongfully deny and terminate long-term disability claims and he is ready to fight for the benefits you deserve.
Many long-term disability claims (not all, but most) are governed by a federal regulation called ERISA. Under ERISA, you do not have the right to a jury trial, and – in most cases – you do not have the right to engage in extensive discovery. This means that most of the work is paper-driven, involves a lot of brief writing, and a lot of correspondence by mail. It is highly unlikely that a court appearance will be required, and as a result, we can handle a federal court case anywhere in the United States. We have even represented claimants that live outside the United States!
Social Security Disability Claims
We have always had the capacity to represent Social Security Disability claimants across the country since Social Security is a Federal program, but prior to the COVID-19 pandemic, it was impractical due to the travel requirements. However, the Social Security Administration has since closed its offices indefinitely and hearings are being conducted via phone. This has eliminated the need for representatives to travel to various hearing offices across the country. As such, we will now be accepting Social Security Disability cases from claimants across the country!
Administrative Law Judges are also looking into the possibility of conducting hearings via Microsoft Teams. This would allow the Social Security Administration to resume video teleconference hearings, but it won’t be necessary for the claimant or their representative to travel to an approved hearing site. The Administrative Law Judge, the claimant, and the representative would be able to join the video teleconference from the comfort of their own home or office.
