We recently had the privilege of representing a former claims adjuster for an insurance company who faced an overwhelming array of health issues. Her life was deeply affected by chronic severe pain and a series of debilitating conditions, including osteoarthritis, fibromyalgia, and complications following breast cancer, among others.
Lincoln National Cut Off Long-Term Disability Benefits After Two Years
After paying her two years of disability benefits, her insurance company, Lincoln National, decided to terminate her benefits as her policy moved into the “Any Occupation” stage of disability. Lincoln National, also known as Lincoln Financial Group, asserted that she could perform sedentary work (a desk job).
Determined to overturn this denial, we meticulously reviewed every detail of the claimant’s medical records and the nuanced insuring clauses in her insurance policy. Our team gathered extensive evidence, including detailed statements from her medical providers, highlighting the severity and extensive nature of her condition. It was clear that her symptoms and limitations significantly compromised her ability to perform her previous job or any job.
We Successfully Appealed the Long-Term Disability Denial
In our appeal, we argued vigorously against Lincoln’s decision:
- We pointed out that their demand for certain types of medical evidence was beyond what the policy required and ignored the comprehensive medical documentation we provided.
- We emphasized that the combination of the claimant’s physical and psychological ailments severely limited her capacity to maintain regular employment, even in a sedentary position.
- We argued that Lincoln National did not fully consider the erosion of the sedentary occupational base and that, because of her conditions, the claimant could not perform the occupations Lincoln suggested. Backed with solid data and expert opinions, we challenged Lincoln’s assessment of the jobs the claimant could supposedly perform.
After thoroughly reviewing our appeal, Lincoln overturned its denial and reinstated the claimant’s benefits. She received over $25,000 in past-due benefits. If she continues to meet the definition of disability, the total potential benefits recovered into the future will exceed $150,000.
This victory was not just a win in terms of financial support for our client, but a validation of her condition and struggles. It also underscores the importance of dedicated legal support in long-term disability claims.
