First and foremost you have to prove that the at-fault driver was negligent in causing the accident. Next, you have to prove that you were injured in the accident, so you have to have medical records to show that you had injuries in connection with the wreck. Finally, there must be causation. In other words, you have to show that the injuries that you’re claiming were directly caused by the accident. For example, if you had preexisting conditions and those injuries were not really related to the accident then you’re not gonna be able to make a claim for those injuries, but if you had anything new caused by this wreck you can make a claim for those.
